First Conviction of Identical Twin Using DNA Evidence

Dramatic courtroom scene depicting the trial of a cold case involving DNA evidence

News Summary

Russell Marubbio was found guilty of a 1987 sexual assault in Woodbridge, Virginia, marking a historic first in the U.S. where DNA analysis led to the conviction of an identical twin. The case, unsolved for decades, was revived through advanced DNA techniques that identified rare mutations differentiating him from his brother. Detective Giannina Pinedo and her team collaborated to solve this cold case, underscoring advancements in forensic science. This conviction highlights the potential for DNA technology to bring justice even years after a crime.

Woodbridge, Virginia – On August 21, 2025, Russell Marubbio, 54, was found guilty by a jury for a 1987 sexual assault in Woodbridge, marking a historic moment as the first successful conviction of an identical twin using DNA analysis in a U.S. court. Marubbio was charged with assaulting a 50-year-old cashier at a Chevron gas station at knifepoint on December 19, 1987, a case that had remained unsolved for decades.

Following the assault, the assailant left behind semen at the scene, but initial DNA results did not match any offenders listed in the Combined DNA Index System (Codis). The investigation went cold until 2019, when Master Detective Giannina Pinedo, who has 22 years of law enforcement experience, was transferred to the cold case unit and began the process of reopening the case.

Working alongside Detective Colleen Grantham and crime scene investigator Andrea Feldman, Pinedo collected and re-examined the evidence, ultimately submitting the DNA for advanced analysis at Parabon NanoLabs in August 2022. The advanced techniques utilized by Parabon revealed the possibility of identical twins being involved, as their DNA is nearly identical. However, deep whole-genome sequencing detected rare somatic mutations that allowed investigators to differentiate between the Marubbio brothers.

The bioinformatics analysis successfully matched Marubbio’s DNA to the evidence collected from the crime scene, leading to his arrest on June 23, 2023. After being released on bond later that month, his bail was revoked following the conviction. Sentencing for Marubbio is set for November 7, 2025.

The successful use of DNA evidence in this case sets a significant precedent for future legal actions involving identical twins. Commonwealth’s Attorney Amy Ashworth highlighted the importance of this ruling, noting its potential to impact how courts handle DNA identification moving forward.

The investigative techniques employed in this case included genealogical analysis, which was conducted by CeCe Moore, the chief genetic genealogist. This analysis traced the Marubbio family line back to the 1860s, facilitating the investigation further. Detectives also collaborated with multiple labs across various states to gather the necessary evidence and resolve this long-standing case.

This case exemplifies the advancements in genetic genealogy and forensic DNA technology that can provide closure in cold cases. Virginia has previously witnessed the resolution of cases using similar methodologies, most notably the apprehension of the notorious Golden State Killer.

The conviction of Russell Marubbio underscores how modern investigative techniques can lead to justice, even decades after the crime has occurred. As law enforcement agencies continue to enhance their use of sophisticated forensic methods, cases that once seemed unsolvable can now find resolution, bringing justice not only to victims but also to the communities affected by these heinous acts.
